kartikbala Posted May 21, 2012 Report Share Posted May 21, 2012 I had a 7th year extension valid untill june end. I got that even when i didnt have Labor approval. My company filed a labor for me this feb and i got a audit now. My h1b expires in next month. Can i still apply for a my extension stating my labor is in Audit and i need one year extension considering labors audit could take anywhere between 2-8 months. Secondly is there a grace period of 6 months after h1b expiry that i countinue to work while my labor audit is in process? What are my options to continue to work without leaving the country? Can i atleast get one more year of extension while labor is in Audit Link to comment
kalyan_ac Posted May 23, 2012 Report Share Posted May 23, 2012 To be eligible for H1b extension, the labor should be pending for more than 365 days which is not the case given your details. There is no grace period. Link to comment
kartikbala Posted May 29, 2012 Author Report Share Posted May 29, 2012 But if i have got an admission from an university for the summer session starting July 2nd and can i apply for change of status to F1 now and continue on that till my labor gets approved and 140 gets approved?
