srinavin Posted May 17, 2012 Report Share Posted May 17, 2012 Hello, I have just joined my company and got only the H1B receipt. I am still waiting on the rest of the process to complete. However, I want to change my company now. Am I legally allowed to retransfer my H1B before the rest of the process completes ? Any advice would be really helpful. wiweq Posted May 17, 2012 Report Share Posted May 17, 2012 Yes, you can. Use this receipt and proof of last status for new H1b application. This will make sure you were in valid status for last 2-3 months while H1b filing. Link to comment

But the risk is that if new employer's petition is denied, and if old employer has revoked their petition (will not take you back), you will be left out of status and you will have to leave the US immediately.
