aryaa
Hi All, I would like to know whether two different employers can file for my H1B for FY 2013 cap. If I get the approvals from both, I will work for only one employer. But my question is will USCIS grant two H1Bs for me (Process both the applications independent of each other) I am sure this question might have been asked earlier but I would really appreciate if someone can please answer this again. Thanks in advance. Regards, Aryaa. Link to comment
Attorney_22
Generally speaking, yes- USCIS will adjudicate multiple H1B petitions filed by different employers on a Foreign National’s behalf. In regards to the petition qualifying for the H1B category, USCIS will adjudicate them independently. However it is possible USCIS will utilize data mining to ensure there are no discrepancies in the Foreign National’s information. If you would like to discuss this in more detail it is advisable to speak to a qualified U.S. immigration attorney. Link to comment
wiweq
You can have multiple H1b filed/ approved from different employers. You need to choose at least one and maintain your H1b status with them by working for them and getting regularly paid. Link to comment
