hello2gautam Posted May 16, 2012 Report Share Posted May 16, 2012 I spent 6 years on L1A then moved to F1. After completion of studies could I work on H1-B. I never went out of USA but got status change from L1-A to F1.If I did not get F1,could I work on OPT? Link to comment
Attorney_22 Posted May 16, 2012 Report Share Posted May 16, 2012 Generally, time spent in L1A status is counted against time spent in H1B. Therefore, unless you are eligible for an H1B past the normal six year limitation such as on the basis of a labor certification or approved I-140, you will be ineligible to change status from F1 to H1B. If however you have been abroad for one year or more, you may be eligible for a new six year period of H1B status. In either case, if you are in valid F1 status and your program is authorized to grant OPT work authorization, your H1B limitation will not affect your eligibility for OPT.
