My previous H1B I-797 expired in May 2011 and now my company is filing for same H1B extension. As per my understanding, my H1B extension case doesn't come under FY12 H1B cap. Please let me know if my understanding is correct. I have another question. After getting extension, for how much time I would be able to stay in USA? Should I be able to stay for remaining 2 years and 8 months or I will get another term of 6 years? Please reply!!! Regards, Pranav Bansal Link to comment
kalyan_ac Posted May 15, 2012 Report Share Posted May 15, 2012 Since you were outside of US for more than a year and your previous petition is filed some where in 2004/2005, you will be cap-subject i.e you come under quota and you will get a fresh 6 yr term if approved. Link to comment
