H1B 7th year extn with PERM approval and I-140 in progress

Hi to everybody,

I am going to complete my 6 years in Sep 2012. My employer filed PERM on Feb 29th. It is in progress.

currently PERM approval is taking 70 to 110 days. If my case did not go for audited i will get an approval but may not be able to complete I-140 before expiration.

Can we apply for 7th year extension if PERM gets audited?

If perm gets approval and I-140 is in progress still can I apply for H1B 7th year extension ?

Please let me know if you know the answers on my situation.

as far as I know, the only way to get 7th year extn is if the PERM is filed 365 days before H1 expiry date or if I140 is approved,

please consult a lawyer.

if your LC PERM gets audited, you can only apply H1 extension [beyond 6 years] after LC is pending for at least 365 days (3/1/2013 or later).

if your LC PERM got approved before 9/2012, you will need to apply I-140 PP because you can only apply H1 extension [beyond 6 years] if you have an approved I-140 (or the condition stated above - LC for at least 365 days).
