Right now I am working in NY and my employer didnt file any saparate LCA for my NY Project. My Employer in NY has offered me full time position. I am little worried about how i have to put my experience in resume for H1 Transfer. Now my question is: If i mention my current project which is in NY in Resume and if USCIS checks my latest LCA which is NJ based then will it be a problem in H1 transfer? Please help me on this...!! wiweq Posted May 15, 2012 Report Share Posted May 15, 2012 As per H1b regulations, LCA should be updated before its effective. First you need to report this to ICE about this. If you don't do this, it may bite you later on. Even though it's your employer job to update the LCA, getting updated LCA is your right. USCIS tell that an H1b employee should be aware about their rights. They also give you a handbook of H1b rights during stamping. These days USCIS is calling H1b employees to match the H1b/ LCA details, and cracking down those who are neglecting H1b laws. I resume just write what is true. Employer is one who is paying you.
