New H1-B filing after India trip

Hi,

I am currently working on OPT Stem extension & I have to file H1-b visa this year. I came to United states on April-22nd ,2012 from India & I heard it is always good to file H1-B visa after 60days from arrival date to US.

If I file my H1-b visa before 60days from my arrival date, will I have any problem with my H1-B approval?

I wonder how can you file your own visa? Do you mean by paying for H1b fees to your employer. Don't do this, it's illegal. These days USCIS is cracking down to the people who are neglecting H1b regulations.

I am neither filing my H1-B visa nor paying my employer to file my H1-B visa. My employer asked me to submit the documents but I heard about the 60days wait period from other employees.

There is no such thing as before or after 60 days.You can file anytime before the quota is filled.

=> So use "my employer will file my H1b" rather "I'll file by H1b" which looks suspicious.

Back to your case, there is no such thing of 60 days. If you heard such thing, add link to what you heard.
