rspvt Posted May 14, 2012 Report Share Posted May 14, 2012 I entered US on H4 then i moved to H1 but didnt work on H1 due to my pregenency. It was about 10 months without any salary or pay checks then i went to india got my passport H4 stamped and entered US on H4 now I wanna search for job...Can i use my old H1 (Which is still valid) . If so just change of status would be enough to work? or will there be any issues in approving H1? btw My employer didnt cancel my H1..Please pour in your thoughts on this Link to comment

You were lucky that you got your H4 approved, otherwise you would have got 3-6 years ban for US entry. Your new employer needs to file H1b with COS for you to let you come back on H1b status. I would suggest you to be aware of H1b regulations and rights. As a reminder, never pay for H1b fees. It’s illegal. Link to comment
