H4 travelling to India. Extension is pending. I94 expired. Need advice urgently.

Hi,

Could you please let me know if there is a problem here?

My(H1) I94 got expired in May7, 2012 and my employer filed an h1/h4 premium extension in April 2012 and received the receipt numbers. Unfortunately, I received a RFE and it is in progress.

My wife and kid (H4s) are travelling to India on May 15, 2012.

She will be back to US only after we get extension approved and after h1/h4 stamping in India.

Is this not possible to travel when H4 extension is pending and with I94 is expired?

Also will there be problem in airport or in Hongkong (travelling via), since she will handover her expired I94?

Please advice.
