Green Card Processing Criteria For EB-1(C)

All,

I have a Bachelor (years) and Master Degree (3 years) and worked for XX company in India for 7 years (2003 - 2010). Came to US through XX company and after being here in US for 3+ years moved to company YY.

Now I have worked for more than a year (2010-2012) in company YY where they are ready to file my GC either in EB2 or EB3. For EB1-C - Company YY said I should have worked in offshore India for YY company.

Now I got to know that there is a matching job opening in my prev company XX.

They are also processing GC for their employees.

Question is, If I join back XX company, Am i eligible to request them to process my GC in EB-1©.

Can my XX company consider my past work experience in their concern in offshore and proceed my processing in EB-1©.

I am interested to join back XX company only if I am eligible to get processed my GC in EB-1©.

Please suggest.

I think the 1 year offshore experience needs to be within the past 3 years. if that is true for you then you should still be able to file through EB-1, assuming all other possible conditions are satisfied too.
