I have initiated my H1B transfer with other company and my joining date will be May 21st, 2012. The H1B transfer is on Premium processing and its already received by USCIS and waiting for receipt number. During May 09th, 2012 to May 20th, 2012, will I be Out Of Status. Any suggestions are appreciated. Link to comment
wiweq Posted May 3, 2012 Report Share Posted May 3, 2012 Ideally, you shouldn't have any gaps in 2 H1bs. It’s totally up to USCIS, they might look at it as out of status or just ignore this. "I have initiated my H1B transfer with other" - I wonder how can you initiate an H1b transfer. In my knowledge, only employer can process an H1b for you. Link to comment
