221g_hyd_mnc_nov22 Posted May 2, 2012 Report Share Posted May 2, 2012 Hi, My New employer has sent my H1 transfer petition in Premium Processing on 26th March 2012, the same day i joined the company. It got RFE on this after 2 weeks and they are asking for client letter, employee-employer relation docs, signed I-9 doc, pay stubs etc., The questions i have on this are: 1) Is it legal to join the company on the day the employer sends the petition to USCIS (not the receipt date). 2) i signed my I-9 after joining the company. Is it ok? 3) What is the possibility of the petition getting denied even i have all the valid documents? Can you please clarify these? I am in big confusion now. Thanks, Vishnu Link to comment
wiweq Posted May 2, 2012 Report Share Posted May 2, 2012 If the employer give the reply to RFE questions as USCIS want, everything will be good. Nothing is in your hand. I always suggest join the employer only after H1b is approved. This makes life way easier. This can be done by processing H1b in PP. If employer is not interested in paying for PP, beneficiary can also pay for this. Next time, stick with this. Back to your case, joining with the filing of H1b has no issue so far. Link to comment
