Complicated H1 ( Non-Profit to Profit) and India Trip - Help!!!

Hello,

My friend was on a Non-Profit H1 working with the university and another guy in the university had a Company and transferred him there and applied for a Industrial H1. My friend is expected to work 80% in the company and 20% in the university.. My questions

  • The Original Non-Profit H1 is already stamped on my passport. If he is making a trip to India, would he need to re-stamp it now that the Industrial H1 is active ?

  • Would there be a problem if my friend works Both in the University and Industry( Since his work still involves 20% in the university)?. ALso, his university H1 was originally valid until 2014. or does the Industrial H1 replace University H1 and he should be working under only industry?

Thank You in advance for your advice and help. He really needs some clarity as there's an India trip next month.

Did he apply for concurrent H1b? If so, there he has to atleast work for the university 50% of the time.

I am not sure, how he can work at 2 place without a concurrent h1b. Because otherwise, he will have to file for an amendment with the university visa - 20% and apply for a fresh h1b cap-subject inorder to work for the industry 80%. And if thats the case, then Yes he will need to go for stamping.

This sounds really suspicious. If this is being done for research grant proposals, it is even more questionable. The other guy likely is a LPR or USC will not be the one being banned if it is found to be an improper arrangement. He needs to talk to the international personnel specialist in HR at the university.
