7th year extension during perm under supervision recruitment

hello sir/madam...

I am here from nov.2006 ON H1 VISA .this sept 30.2012 i am going to complete 6 year of h1 b visa...my labour is under supervision process.....

my condition is that we want to stay here till our f4 immgration date will current ..its april 2003....now 2000 dec going on....my lawyer says on the behave of pending labour we can extent our h1 7 th year...and if labour deny we will put appel and on that behave we can extent may be 8th year.......

please suggest me can I go for f1 visa now

or I have to stay on same track......

I got 7th year Extension during my labour is undet supervisor audit
