I have my I140 Approved . Can you please tell me what is the best time to file for Extension and whats the USCIS fees . Will I get 3 yrs extension .? Appreciate your quick reply . However, the extension is still subject to USCIS approval so it will still be necessary to establish the employer has work available for the period requested. Additionally, the extension petition must be filed prior to the expiration of your current H1B status. USCIS allows an H1B petition to be filed within six months of the requested start date. For questions regarding fees it will depend on the specifics of your employer, therefore it is best to refer to the fees described on the I-129 instructions.
