L1-B to H1-B -> COS or new H1-B

Hi All,

My L1-B expires on 26th Oct, 2012. I want to change it to H1. My employer does not have any knowledge on H1-B filing. Can some one please let me know whether my company needs to file for Change of Status or file for a new H1 B ?

You are on L1 and going on H1b. I think it’s a change of status and needs to file COS. Ask your employer to hire attorney or leave the H1b ignorant employer.

It is always a new H1. COS is just a checkbox on the form.

If you are in the US, you generally want to do COS.

The employer should consult with an immigration lawyer to avoid any problems.
