My employer has confirmed that he is going to start GC process. My question is what would be the possible constraints to stay back after my visa expires and while the GC process is ON. Does my GC process have to complete any stages before my visa expires? Link to comment
cooltoo8190 Posted April 30, 2012 Report Share Posted April 30, 2012 Once 5 yrs are done you have to leave the country if GC is not approved because on L1B the max period one can stay is 5yrs even though I-140 is approved(GC is in process). This is what you should do:- 1. File for H1B 2013 quota immediately. It may fill up by June. Once H1B is approved file for GC immediately. 2. File a transfer for L1A if possible. Then file for GC.
