bat_bat
Hi, I got my H1 approved in 2007. I didn't work for almost 1.5 yrs and then finally got a project. However I worked for only 1 month and had to leave my job for personal reasons. I immediately filed for COS and had my H4 approved. Therefore I have only 1 pay stub for the month I worked. Now I have a potential employer who is ready to file a H1 for me. My question is: 1) Will this be a case of H1 transfer? 2) Will my earlier history be checked? 3) If yes, then wll I have to submit pay stubs/w2 while transfering the H1? All help/advice is appreciated. Thanks. Link to comment
ninad70
1) Will this be a case of H1 transfer? No this would not be a H1 transfer and you will need to make a fresh H1B application. You don't need to be counted against the quota again. 2) Will my earlier history be checked? I believe so. 3) If yes, then wll I have to submit pay stubs/w2 while transfering the H1? You won't need prior pay stubs since this would be a transfer from H4 visa. Link to comment
