rampan
Question: Does my wife need to apply for H4 status ? Is it considered out of status ? Our situation: My wife is on OPT (12 month started Feb 1st 2012) and finishing 90 days of her OPT period on 4/30/2012 but could not get a job. As I know one can stay on OPT without a job for only a max of 90 days. But we (I & my wife) filed for i-485 recently (receipt: 03/13/2012), fingerprinting done last week for both (April 19th 2012), waiting for EAD cards. Please assist if H4 need to be filed to avoid future problems. Note: USCIS website not showing I-485 status (same problem for many people) Link to comment
JoeF
The pending I-485 keeps her legal. No need to change to H4. Forget the online status. That is known to be unreliable. As long as you have the receipt notices, you are good. Link to comment
