1. You can email to the consulate about the confirmation that you are willing to take further this case and do not want any movement, kind of withdrawing the petition from the consulate.

2. No, you will not fall into cap lottery as you had H1 status earlier and not residing abroad more then a year, you should be fine for cap exempt.

The quota is about H1 petitions, not H1 visas.

If you have counted for the quota in the last 6 years, you are not counted again.
