COS and Long stay in India

Hi,

My wife was on H1 and applied for COS (H1 to H4) in Mar 2011. She left to India in May 2011. We received a letter stating the COS was denied and applicant needs to reapply or go for Visa in India. Since then she has been in India. We also have a 8 month old baby (Indian citizen). Now want to apply H4 for wife and son as they plan to come back. Please let me know if we need to be cautious about anything. My Visa is stamped until 2014 and all clear on my side however I am on EVC model.
