I-485 Pending (Received EAD/AP)

Hi,

I am in a tricky situation. Any advice is greatly apprciated

My I-485 is pending (EB-1) (receipt date Nov 25, 2011) with current employer. Got my EAD/AP in Jan 2012 (H-1B expires in Dec 2012). My current employer is getting aquired by a new company in 45 days from now.

If I get laid off after 45 days (I-485 is still pending at that time) and I do not have a new job by then,

1) What happens to my green card process? Will I have to start all over again?

2) Will I go out of status?

Yes you will have to start over if you are accepting a new job offer.

Yes you will be out of status.

Thank you so much for the reply. Can you please let me know the following.

1) How many days can a employee stay unemployed (If he loses a job) while I-485 is pending with out losing the status?

2) I have EAD. Will it not help me maintain the status?
