H4 to H1B COS

Hi

I am currently employed on H1B. Planning to take few month vacation in India. Hence I will be need to come back to US on H4 visa.

My question is upon coming to US on H4 visa, can I immediatelly apply for a change of status to H1b ?

Or is there any 90 day waiting period before I can change my status ? Should I have to stay in US for 90 days on H4 and only then I can change my status to H1B?

Once you get a job, your employer will file your H1b extension with COS. This can be done anytime, once you are in USA again. 90 days waiting period is nothing.
