Urgent - Have Valid H4 and H1B. Want to Quit , Need Advice

Hi,

Me and my husband both were employed in India. Both had H1b. my husband got a project in US and he had travelle on H1. As i did not have an oppurtunity in US, I filled for H4 and travelled to US on H4.

But my passport has both H1 and H4 . None were cancelled.

Later, I got a project in US , travelled to india n came back with H1 b.

Now, I want to quit due to health issues. There are queries

1) Can i quit while on H1b here ? Can my employer stall me telling that I have to continue till they are ready to let me go ?

2) Do i have to apply for COS or should i travel back to India n come back once again ?

3) If i decide to quit and my employer agrees , will my last working day be the last day i can stay in us legally on h1 ? do i hve to travel to my home country on the same day ? please advice.

Employment in the US is "at will", which means that both you and the employer can terminate the employment relationship at any time.

You can just file an I-539 for COS to H4.
