legalstinson
Tale of three brothers - B1, B2, B3. B1 - US Citizen B2 - Indian Citizen B3 - Indian Citizen B2 has his own apparel company established since 2000 in India. B3 has been helping B2 by managing his company and handling vendors. B2’s business is doing very well in India and he has had a lot of customers from USA that has purchased from him while in India. Looking at the demand for his products in USA, he wants to expand his business and open a branch here in the USA. B2 cannot relocate to USA since his company headquarters is in India and he’s married and settled in India with wife and kids. B1 is interested in investing and starting the branch here. However, he is also the vice president in another company and has a full time job. He cannot handle the business on his own completely. He wants to bring B3 here to manage the company and business. He’s looking to hire more people as the business is established and grows. What are the options for B1 to bring B3 over here? Will he be able to sponsor a visa or green card based like transferring a manager from India to USA? I’m not sure if this post is under the right category so if it has to be under another category kindly redirect. Please advise. Thank you. Link to comment
JoeF
Looks like the L1 visa would be the appropriate category. Link to comment
BigJoe5
There is the potential to make B3 into an L nonimmigrant in order to open a "new office". It would not be simple and easy but is possible. Link to comment
legalstinson
Thank you for your responses. Does B1 need to hire an attorney or can he do it himself? Link to comment
JoeF
Getting an immigration lawyer would be recommended, since they apparently don't have much knowledge about immigration issues. Link to comment
