I am working in say 'x' STATE and my paryoll has state deductions from 'Y' STATE and the address on my payroll is the work place of my state 'x' . My question is - I am going to complete my 6 yrs of H1B in the month of July 2012 and I had to file for H1B based on my I-140 ( Approved ) . Will their be a problem on H1B petition taking the above scenario of x and y states being different . I am worried but my employer says no issue . Please clarify asap - i am very much worried . Another quick question is how much extension period I am going to get based on I-140 Approval . My client is ready to give ( Client Letter ) period from 1 to 3 yrs . Please advice and let me know . vgowri Posted April 16, 2012 Report Share Posted April 16, 2012 As far as I know staying in one state and working in another state normally has no bearing for H1b extension. I live in NJ and work in NY and got my I-140 approved and also got my H1b extended. With I-140 approved subsequent H1b extensions are normally for 3 years. Link to comment
