The US government can not monitor hundreds of thousands of companies.

You just need to use common sense.

Does the company pay on bench? Do they give that to you in writing? If not, stay away.

Does the company want you to pay for all or part of the H1? If yes, stay away.

Does the company want you to sign a contract saying that you have to work there for at least a certain amount of time? If yes, stay away.
