Shaunakonline
Hi, If I am laid off, My old employer has revoked the visa/petition and my new employer has an approved I797. I am going for visa stamping. What should be the answer for following question while making an appointment with Consulate for visa interview ? Q. Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?* Yes / No You are Not eligible if: Is Applicants whose last valid visa has been either cancelled or revoked? (Yes - NO) Also Refer below links for navigating where I got that question. caindian
Do u have visa stamped on ur passport for ur previous employer ? is it expired with in last 12 months then Select YES otherwise NO. My case is visa from previous employer got expired in march 2011..but I m working here based on extended i797 from previous employer and then pending i797 from new employer so I selected NO I heard that its not important factor....just my opinion. Experts any suggestions.... Link to comment
livliv
Visa in passport is called Visa. Petition is called petition. Both are not the same. What employers can revoke is only petition and not Visa. So answer according to whether Visa in passport is valid/expired within last 12 months or not. Link to comment
