STEM extesnion filing for H1B

Hi all,

I have been working for an E-Verified company since Jan 2011 till Jan 2012. Got my OPT STEM extension and now its Valid till June 2013.

Recently I have joined Full time for a company (which is not e-verifed) in Feb 2012 and they are planning to file my H1B. But in the last moment I stopped them from filing my H1 B by bringing this e verify issue as a concern. Now they want to transfer me to their child company and file my H1 B from that company.

Now my question is as i am on STEM OPT .. working for a non e verified company for a month will make me out of Status .? Can i file my H 1 with non everified company .? does it make sense to transfer to their child company..? Please need your smart opinions.

can you use CAP-Gap once you get H1b receipt ? I am not 100% sure if you can do that.
