L2 to H1

I am working as a contractor in L2 EAD. My client wants to join as a Fulltime employee and they can file H1B for me but my current employer wants me to work as a consultant for couple of more months. Is that possible to get the H1 B filed by client and continue working with the current employer even if I am not in payroll of the client.

Generally, cap subject H1B petitions may only request a start date of October 1, 2012 or later. Thus, the petition can be filed now for an October 1 start date and the beneficiary would need to maintain L2 status up until the start date on the petition.
