We are planning to go out of the country and while coming back, we are debating which scenario will be helpful. Any advice would be much appreciated. 1. Both of us go for stamping- mine is doubtful since I work for a consulting company. In case stamping gets delayed/denied, i come back on AP and change status to EAD. My wife works as a full time employee and chances of her gettting visa is higher, so she doesn't have to use EAD. In case something goes wrong with my I 485 application, can i change to dependent visa on my wife's H1? 2. Can we both come back on AP and change to H1 again since our 797 is valid 2015 and 2014? 3. And of course, the best scenario where we stay put till we get GC. Link to comment
spenumatsa Posted May 3, 2012 Report Share Posted May 3, 2012 1. Not advisable. 2. Both of you can use your AP to enter the country and file an ammendment to get back to H1B status. 3. If your visit can wait, best option. Rememebr that you wont be getting your green cards any time soon. Not atleast the end of the year. Link to comment
