JammieT Posted April 4, 2012 Report Share Posted April 4, 2012 Hello ! , I am currently on my H1 B Visa with Employer A , Which is set to expire in Feb 2012 ( this is my 6th Year ). I am planning to switch my employer to Employer B . I already have an approved I 140 under EB2 . My question is : Can my employer B file the 3 Year H1B extension on the basis of Approved I140 from Employer A ? Given that I am in very good terms with employer A, he is not going to Cancel the I140 Can such extension be filled by employer B ? Thank you in advance. T. Link to comment

Here is my scenario and my question. Hi All, I currently work for employer A in H1B status. I am completing my 6th year on May 2012. My employer A applied for the H1B extension and i got my extension until May 2015 I also have an approved I-140 in EB3 category from employer A with the Priority Date: 2/10/2011. I have a couple of questions regarding transferring my H1B to employer B Is it safe to transfer my H1B to employer B and start my new job ? If my employer A revokes my I-140, will it void my H1B that was transferred to employer B ? If my employer B is willing to start a new GC processing in EB2 category, can I port my previous priority date ? I would really appreciate a response to my questions since I am looking for a change quickly. Thanks in advance Link to comment
