myH1Query Posted March 27, 2012 Report Share Posted March 27, 2012 Hi, I got my H1 petition approval in 2004 , traveled to US in 2005 Nov, got a petition extension in 2007 and it got expired in 2010.Though I went back to India in 2009.Subsequently I travel to US on 2011 on L1 and still working on L1. If I file a new H1 this year, do I need to go through Quota, or is it quota exempt (As I was at US in past 6 years in H1 status.)? Link to comment
JoeF Posted March 28, 2012 Report Share Posted March 28, 2012 An H1 would have to be in the quota. You would only be quota-exempt if you had been counted for the quota in the last 6 years. Approval in 2004 makes it 8 years in the past. Link to comment
