filing h1b with one employer now...what if i get another offer from different company

Hello all,

I am filing for H1-B this april with my current employer, However after applying to USCIS, if I get another offer from a different company, Can I apply H1B with the new company?

is this allowed? Remember these are two different employers..

Any insight is greatly appreciated

Technically, this is allowed. But I would suggest that you wait untill the current visa approaval before you file with another employer. I have assumed that you meant to say you are applying for a visa extension rather than a new H1B.

Its not clear if you are out of states or what your status is now if you are in the states.

To answer your question, yes you can apply for two different employers at the same time.

i am in USA. my current status is OPT

i have a new question now

my opt expires by June 6th.

My current employer will file for H1B now.

Case: 1 Let us say it is in process at USCIS (not yet approved)

Now, if i get a new Job at another company and let us i can ONLY join that company on June 1st. That new company cannot process a new H1B by June 6th. What are my options in this case

Case 2: Let us say that my current companies H1B got approved before June 1st (that date of the new company)

because it is approved, can i transfer my H1B to new Company after June 1st

what are my options in this case

First of all, the h1 does not start until Oct 1st or later.

Your OPT expires on Jun 6th.

What is your status going to be between Jun 6th and Oct 1st?

You cannot changes employers without having atleast 2-3 paystubs.
