H1B -- beyond 6 yrs

Hello all,

I am in my sixth year of my H1 b valid till Dec 12 2012. My PERM has been filled before 365 days (filled on Dec 02 2011) and received a random audit. My employer is currently looking for responding the audit. Would I be eligible for I year extension of my H1-B if my PERM application is pending. is there any Labor law I can refer to. Later, my Employer is also not sure if my H1-b can be extended.

yes, you will be eligible to apply H1 extension beyond 6 years once your LC is pending for at least 365 days. an individual is also available to apply for H1 extension beyond 6 years if he/she has an approved I-140.
