H1B Work Visa Procedure

Hello all,

I was doing a job on my OPT and then converted to the H1B work visa in Sep 2008.

The H1B expiry on my passport is Sep 2011.

I got laid off from my company and then went back to India in December 2010.

Please let me know what is the procedure to look for a job in the US in this situation:

1. Will I be subject to H1 cap count again ?

2. How many more years of H1B work can I do ?

3. Assuming I find a new employer, What do I need to tell them regarding my H1B status ?

Since you have been abroad for over a year, you have two options:

1. Use the remainder of the current H1, without being subject to the quota.2.

Get a new H1 subject to the quota (start date Oct. 1) and get a new 6 years.
