solik Posted March 23, 2012 Report Share Posted March 23, 2012 Hello All, My first H1B was filed in 2008 under Master's degree H1B quota. I was on H1B from Mar. 2008 thru Jun. 2009. I got my H1b stamped in India in 2008 and it was then valid until March 2011. Later, I changed to F1 to pursue my Ph.D. When I got my F1 visa stamped in 2009, U.S. consulate did not cancel my H1B on my passport and granted me F1 visa. I will graduate this August with my PhD. I got a job and want to file for my H1B now. Do I come under the quota or can I just do H1B transfer as I had H1B earlier. Please help me. Thanks is advance Link to comment
livliv Posted March 23, 2012 Report Share Posted March 23, 2012 Your new employer can file a cap-exempt petition with immediate start date for you. Once that is approved with change of status, you can join them. Link to comment
