SH_32 Posted March 22, 2012 Report Share Posted March 22, 2012 Hi, I have a situation where my Wife has a H1B stamping ( expiring on 2015) but her current employer is not able to find her a position in US. My company has applied for my H1B and it got approved. So I am planning to apply for My Wife's H4 along with my H1B stamping. So my question is what will happen to my Wife's H1B if she applies for H4? Will they cancel it or the H1B will be still valid and can she get it transfered while in US and apply for a Change of Status? She might be resigining from her current employer before she travels on H4 with me. Regards Mohan. Link to comment
livliv Posted March 22, 2012 Report Share Posted March 22, 2012 Visa in her passport may get canceled (depending on the consular officer). The underlying petition will not be canceled unless the employer revokes it. Irrespective of the above, another employer can file a cap-exempt petition for her at any time. Link to comment
