lolopot Posted March 22, 2012 Report Share Posted March 22, 2012 I worked for Company B (which was fully owned by Company A) from 2007-2010. Company B had filed for my PERM and I-140 under EB-2 and hence my PD was Nov 2009. However in Aug 2010, our unit was moved into Company A and my H-1B was amended subsequently to reflect the new name. I was told that everything remains the same and nothing would change. But now that my PD is current, Company A says they will have to file my PERM and I-140 again although I will get to retain my PD. But this could take a lot longer and the date would get retrogressed by then. Is there any way they can file my I-485 based on old approvals under the name of Company B? Company B does exist and is still fully owned by Company A although their Tax IDs would be different. Any pointers please? Link to comment
