sats2020 Posted March 20, 2012 Report Share Posted March 20, 2012 My company A did a change of status from L1B to H1B. In L1B, I have already completed 5 years but I have a I140 approval. So when my change of status got apporved I was given 2 years extension instead of 1 year. Here are my questions 1. Will I be able to transfer to an new employee B and still get a 2 year extension? 2. Will company A revoke my I-140? Link to comment
Attorney_10 Posted March 21, 2012 Report Share Posted March 21, 2012 Generally, H1B beneficiaries with approved I-140 petitions are eligible for H1B extensions in increments of up to three years at a time until his/her priority date becomes current. Generally, the employer is not legally required to withdraw the I-140 petition if the permanent position is no longer offered to the beneficiary; however, the employer may withdraw the petition if it chooses to do so.
