Concurrent H1b

I work for a cap-exempt employer and I have a job offer from cap-subject employer. Since my new employer is cap- subject so I cant start working for them immediately and I will have to wait until October. My lawyer has suggested that I can file a concurrent H1b petition so that I can start working before October.

My question is:

1. Is there minimum number of hours that i will have to work for my cap-exempt employer to maintain the status?

2. Can I go for a Leave of absence or an unpaid leave and still maintain concurrent h1b status?

3. Do both the employer have to be in the same geographical location?

4. When is the earliest I can resign from my cap-exempt employer? Will my new employer have to file new independent petition under cap-subject h1-b in April 2012 for me to start working for them in october ?
