Different employer for H1b and EB2

Hello all;

I am currently working on my h1b since last 3 years with emplyer X,who cannot file for my EB2 as the position doesnt need it.

i have my bachleor's and 5+ years exp (including usa & india).

A agency took over administration of the dept i work for and are ready to file for my EB2,so can i continue working for employer X and have the agency file my EB2?

also since employer X is client of the agency they told me they would have to notify employer X that they were going to file for my GC,will this hamper my h1b with employer x or cause any issues with my employment with employer X?

I would really appreciate any inputs as i have to reply to agency soon.
