labor market test failure

Hi,

My company started the LC process late last year and condicted the labor market test and told me that the tests failed. They are working on refining the requirements they used for LC applications. Here is my current status:

* H1-B visa valid until 08/2014 (started on H-1B in 10/2004).

* I-140 approved for EB-2 category with priority date of 11/2007 with the previous employer.

* Started my new job last year - 08/2011 and LC process started 10/2011

What is my best option to get the GC? What happens if the second labor market test conducted by my new company fails again?
