My attorney applied for LCA today (i.e. 03/12/2012) with the dates mentioning as employment beginning 09/11/2012 through 09/10/2015. Question: As per my knowledge H1 starts on OCT 1st. Then why did attorney mentioned these dates ??? If it is Extension he can put any dates. If it is Fresh H-1b then you must say 10.01.2012 to 09.30.2012... Start date has to be 10.01.2012. You better check with Attorney and ask him why he put the date as 09.01.2012. Link to comment
Attorney_22 Posted March 12, 2012 Report Share Posted March 12, 2012 The start date of an LCA must be within six months from the date the LCA is filed. Therefore, in preparing your H1B Cap-Subject filing prior to April 1st, the attorney was required to use September 11th. However, as stated above, your cap-subject H1B employment may only begin on October 1st. Link to comment

So what you said is there is no harm in mentioning diff dates if we are applying LCA prior to Apr 1st. However the cap - subject for H1 always begin on October 1st. Please let me know if I am wrong.
