bhgks1978 Posted March 11, 2012 Report Share Posted March 11, 2012 Question: I am in 6th Year of H1B that expires on 07/13/12(Recapture period is not more than 40 days). Employer filed PERM Labor on 09/12/11(in this sixth year) and it was selected for AUDIT this January. Employer cannot file backup labor until end of May-12 due to some compliance issues. I want to know what could be my options to keep my legal status in US and stay beyond July-12?? Can anyone advice on experiencing a situation similar to this and..what could be the choices...??
