redgreenbluee Posted March 13, 2012 Report Share Posted March 13, 2012 please consult a lawyer. if you have a pending I-485, you can stay in the US while waiting for a decision (AOS pending status). I-485 approval is subject to eligibility of criteria, for example if your I-485 is an employment based I-140, you will need a future permanent position once your I-485 is approved based on the terms of I-140.
