In case I want to change the location of employment by moving from office A in City A to Office B in City B. - Do I need to file an H1B amendment or just an LCA for the new location? - In case I file for H1B amendment will my current petition expiry date be further extended by 3 years or will it remain the same as of current petition. Please note I have been on H1B for only 1 year as of today and my current petition expires Dec 2013. Link to comment
Attorney_10 Posted March 9, 2012 Report Share Posted March 9, 2012 Generally, an amended H1B petition is required anytime there is a material change to the terms of the H1B employment. USCIS is recently taking the position that a change in work location is a material change. Generally, an amended petition may be filed with or without a request for an extension of stay.
