This will be the first time that I will be travelling to the US. Are there any chances of rejection because my wife is currently in the US? Link to comment
Attorney_23 Posted March 8, 2012 Report Share Posted March 8, 2012 A foreign national applying for an L1 visa will not generally be penalized simply because his/her spouse is in the U.S. in valid H1B status. Link to comment

I am planning to visit my wife on a visiting visa in a couple of months, while my company will be filing for L1 after 6 more months. Will my visiting her affect my L1 visa filing process or the visa interview outcome in any way? Link to comment
Attorney_23 Posted March 9, 2012 Report Share Posted March 9, 2012 You would need to be able to show you have worked for the company abroad for at least 1 year in the past 3 years (among other requirements.) Time spent in the U.S. in B status will not count towards that 1 year requirement. Link to comment
