Tejask Posted March 6, 2012 Report Share Posted March 6, 2012 I would complete my total 6 years of H1B in another 2 months(April 2012) and I have I-140 approval but my employer is not ready to apply for my extension, So I decided to convert my H1 to H4 as my spouse is on H1. My question is Can I apply for change of status from H4 to H1 based on my current I140 approval at a later stage if I find a new job? Is converting my H1 to H4 a better option rather than going back to my home country? Please advice............. Link to comment
kalyan_ac Posted March 6, 2012 Report Share Posted March 6, 2012 You cannot use the I-140 approval from the current employer for future employment. The same employer has to be willing to file for extension based on I-140 and at the same time the employer should not withdraw/revoke the approved I-140. Link to comment
